Hosting Facility Standard Terms and Conditions
The following Terms apply to hosting services provided within the Knossos
Networks Limited hosting facility (the "Facility") except where covered by a
specific contract. These Terms are in addition to the
Internet Service Standard Terms and Conditions,
and in combination form the basis of the contract for services between
you (the "Customer"), and Knossos Networks Limited (the "Supplier").
The Supplier may alter these Terms at any time with 30 days written notice.
1. Additional Responsibilities of the Supplier
1.1. The Supplier agrees:
- to maintain the integrity of the Facility, including security, power,
networking and air-conditioning equipment, to the best if its ability;
and
- to permit access only to authorised persons;
2. Additional Responsibilities of the Customer
2.1. The Customer agrees:
- to only house equipment in the Facility that meets all applicable
safety and regulatory standards;
- to follow any and all instructions provided by the Supplier while working
within or relating to equipment placed within the Facility;
- to not leave any potential hazards to persons or equipment in the
Facility; and
- to take all appropriate care when working within the Facility.
3. Liability
3.1. In addition to the Indemnity specified in the Internet Service Standard
Terms and Conditions, the Customer agrees to accept any and all liability
for any damage or loss suffered by the Supplier and/or any other
affected party, including but not limited to:
- fire, smoke or water damage;
- damage to other equipment;
- charges for emergency services call-outs and damage caused by
emergency services personnel in responding to such call-outs;
- charges for call-outs performed by the Supplier or other parties; and
- consequent business losses
as a result of:
- unauthorised interference with equipment, cabling, power supply or
other facilities not belonging to the Customer by the Customer or the
Customer's representative, whether intentional or not;
- failure of any of the Customer's equipment within the Facility;
- excessive power usage by the Customer's equipment;
- triggering of safety cutout devices; or
- negligence by the Customer or the Customer's representatives.
3. Confidentiality
3.1. The Customer agrees that information relating to any party obtained
from within the Facility by the Customer or the Customer's
representatives but not intentionally disclosed by that party is to be
regarded as confidential to that party.
3.2. The Customer accepts any and all liability for damage or loss arising
from use or disclosure of such information.
4. Power Usage
4.1. The Customer agrees to limit power usage to within the specified power limits.
4.2. Unless otherwise agreed, the power limits are:
- one amp per server for individual servers;
- ten amps per cabinet for dedicated cabinets.
4.3. Where there is excessive power usage, the Customer agrees to pay excess
usage charges at the agreed rate or at the Supplier's standard rate if no
such agreed rate exists.
5. Rubbish
5.1. Packing materials and other waste must be removed from the Facility. Such
materials left on site may be disposed of and such disposal charged for
by the Supplier at the Supplier's sole discretion.
